This is a draft. It describes what the software actually does with data, accurately, but it has not been reviewed by a lawyer and is not a binding agreement yet. If you are evaluating NexActiv for a gym, ask us for the reviewed version.
Who this is for
NexActiv is provided to gyms and fitness studios. Accounts are set up by us for a named gym; there is no self-service sign-up, and staff accounts are created only by invitation from someone who already has one.
Your data stays yours
Everything your gym records in NexActiv belongs to your gym. You can export it, and you can ask us for a full copy at any time. We do not use it to build anything else and we do not share it between gyms.
What you are responsible for
Keeping your staff accounts secure, and removing access for people who leave. What you choose to record about your members, and having their agreement to record it — measurements in particular. The accuracy of the GST number and address printed on your invoices.
Payments to you
Online payments run through your own Razorpay account, so money settles directly to you and never passes through us. We hold your Razorpay credentials encrypted and never return them from the software once saved.
Suspension
If an account is suspended — over an unpaid bill, say — it becomes read-only rather than blocked. You keep access to everything already recorded and cannot add anything new until it is reinstated. Cutting a gym off from its own member list over a billing dispute is not something we will do.
Availability
We aim to keep the service available and to keep backups, but this is software and things break. The coach app is built to keep working when the network does not, which is the case that matters most on a gym floor. We do not yet offer a contractual uptime guarantee; when we do, it will be written here rather than implied.
Ending it
You can stop using NexActiv whenever you like and take your data with you. Ask us for an export before you go and we will provide one.
